License Review Board to Meet Oct. 6; Neighbors Urged to Attend

The Atlanta Police Department has filed a ‘due cause’ citation against Allure Gentleman’s Club at 2284 Cheshire Bridge Road NE for conducting illegal nightclub operations on a Sunday. 

Neighbors are highly encouraged to attend the upcoming License Review Board (LRB) hearing, held virtually and set for October 6 beginning at 5 p.m.

The consent agenda items will typically be quickly adopted, so item #10 (Allure Due Cause) will likely be heard shortly after the meeting starts. Neighborhood Planning Unit-F will have a representative attending to speak to the neighborhood's experiences regarding Allure operations.

Due Cause procedures are covered in Section 10-109 of the City of Atlanta Code of Ordinances. 

Sec. 10-109.1. - Mandatory progressive penalties for "due cause" findings by the license review board and penalties imposed by the mayor.

(a) With respect to existing licenses, mandatory penalties for "due cause" findings by the mayor shall be as follows:

(1) First violation—Minimum of five to 60 days to a maximum 180 days suspension of license and $1,000.00 fine;
(2) Second violation—Minimum of 30—180 days to one year suspension of license or revocation and $1,000.00 fine;
(3) Third violation—Revocation.

(b) With respect to existing licenses, mandatory penalties for "due cause" findings by the mayor with respect to licensees holding a license to sell alcoholic beverages for on-premises consumption shall be as follows:

(1) First violation—Minimum of five to 60 days to a maximum 180 days suspension of license and $2,500.00 fine;
(2) Second violation—Minimum of 30—180 days to one year suspension of license or revocation and $2,500.00 fine;
(3) Third violation—Revocation.

Ice Cream Party Fun

We All Scream for Ice Cream

LMMNA’s Ice Cream Party got off to a great start on Sept. 13, and about 20-30 neighbors were able to enjoy the first hour of flavors from Ben and Jerry's Ice Cream.

Our ice cream man unfortunately had a personal family emergency during the event, and we had to end it prematurely. All of us of course send him our best -- and we’ve rescheduled Part II of the event!

For neighbors who were unable to enjoy a scoop of Ben and Jerry's Ice Cream on Sept. 13, please join us for Part II on Sunday, Sept. 20, from 2-3 p.m. It’s back at Armand Park, 2177 Armand Road NE.

Special Election Underway

Update on Special Election to Fill Rep. John Lewis Seat

Early Voting locations for the Fulton County September 29, 2020, Special Election for the Georgia Congressional Fifth District opened on Sept. 8. The AJC has posted a complete guide, including profiles of the candidates.

Early Voting Hours: Tuesday, September 8 to Friday, September 25: 8:30 a.m. - 6 p.m. and Saturday, September 19: 8:30 a.m. - 6 p.m.

As a reminder, this is a special election for the seat left vacant due to the death of U.S. Rep. John Lewis (D-GA), our representative for District 5 who died July 17. It’s one of two different votes that will take place as a result:

To fill the vacant seat:
Gov. Brian Kemp announced July 27 that a special election required for Lewis’ vacant seat will be held September 29. A runoff, if needed, will be held on December 1. The last day to register and be eligible to vote for the special election was Monday, August 31.

During the General Election:
The Democratic Party of Georgia had to appoint a replacement candidate to fill Lewis' space on the November ballot because of his primary win on June 9, 2020. On July 20, Georgia Democrats chose Nikema Williams, the party chairwoman, to replace Rep. Lewis on the November General Election ballot. The deadline to register and be eligible to vote in the General Election is Oct. 3.

Norfolk-Southern Construction Update

Lindbergh Drive past MARTA station to be closed through September

Officials with Norfolk-Southern informed our neighborhood yesterday that the replacement of the railroad bridge spanning Lindbergh Drive just past Pike Nursery has begun.

Parts of this project have been underway a few months and now the trestle itself is being replaced. Lindbergh Drive at Peachtree Hills Avenue will be closed through September 21.  

One sidewalk will remain open during this time. Track outages will be September 13 and September 20; sidewalk access on those dates will be limited and open only when It is safe to pass.

Norfolk-Southern Update: September 14

Lindbergh Road is expected to reopen September 23!

There will be a 24-hour work day, starting at midnight on September 20. This will be the second track replacement. The first one was completed yesterday, September 13.

Please remember to drive slow on your detour. The preferred route, per City of Atlanta, is to use Pharr Road and not the neighborhood streets.
